These Terms of Service (“Terms”) govern your access to and use of the DialedUp website, demonstrations, communications, and services. By accessing our website, contacting us, requesting a demonstration, or using our services, you agree to these Terms.
1. About DialedUp
DialedUp provides AI-powered communication and automation tools designed to help businesses respond to missed calls, communicate with leads, collect information, and support appointment-booking and follow-up workflows.
2. Eligibility and authority
You represent that you have the legal authority to use our website or services and, when acting for a business, that you are authorized to act on that business’s behalf.
3. Acceptable use
You agree not to use the website or services to:
- Violate any law, regulation, carrier rule, or third-party right.
- Send deceptive, abusive, harassing, fraudulent, or unauthorized communications.
- Upload malware, interfere with systems, or attempt unauthorized access.
- Misrepresent your identity, business, products, services, or authority.
- Use collected information for purposes that are unlawful or inconsistent with the consent provided.
4. Customer responsibilities
Customers are responsible for providing accurate business information, keeping account credentials secure, maintaining lawful consent for communications, honoring opt-out requests, and ensuring that their use of DialedUp complies with applicable laws and industry requirements.
5. SMS and mobile messaging terms
Program name: DialedUp
By providing your mobile number and affirmatively opting in through a DialedUp form, chat widget, or other documented consent method, you agree to receive text messages from DialedUp related to your inquiry, requested demonstration, scheduling, customer support, service updates, and other communications described at the point of consent.
Message frequency varies. Message and data rates may apply. Consent to receive marketing or promotional messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.

6. Fees and payment
If you purchase paid services, pricing, billing frequency, and any setup or usage fees will be stated in your order form, checkout page, invoice, or separate service agreement. You authorize us and our payment processor to charge the payment method provided for amounts due.
7. Cancellations and refunds
Cancellation and refund terms, if applicable, will be described in the plan, order form, invoice, or separate service agreement associated with your purchase. Unless otherwise stated in writing, fees already paid are nonrefundable to the extent permitted by law.
8. Service availability and changes
We may update, modify, suspend, or discontinue portions of the website or services. Features may depend on third-party platforms, telecommunications providers, internet connectivity, and customer configuration. We do not guarantee uninterrupted or error-free availability.
9. No guarantee of business results
DialedUp does not guarantee any specific number of leads, appointments, customers, conversions, response rates, revenue, savings, or other business outcome. Calculators, examples, projections, demonstrations, and testimonials are illustrative and do not guarantee future results.
10. Intellectual property
The DialedUp name, branding, website, software, designs, text, graphics, and other materials are owned by or licensed to DialedUp and are protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from them.
11. Third-party services
Our services may use third-party providers for hosting, telecommunications, artificial intelligence, customer relationship management, scheduling, analytics, and payment processing. DialedUp is not responsible for outages, delays, data practices, or other actions of third-party providers outside our reasonable control.
12. Disclaimer of warranties
To the fullest extent permitted by law, the website and services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law, DialedUp will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the website or services.
14. Indemnification
You agree to defend, indemnify, and hold harmless DialedUp and its owners, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from your misuse of the services, your communications, your violation of these Terms, or your violation of another person’s rights.
15. Termination
We may suspend or terminate access to services for nonpayment, misuse, unlawful activity, security risk, or material violation of these Terms. Provisions that by their nature should survive termination will remain in effect.
16. Governing law
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute must be brought in a court of competent jurisdiction located in Oklahoma, unless applicable law requires otherwise.
17. Changes to these Terms
We may update these Terms from time to time. We will post the revised version on this page and update the effective date above. Continued use after changes become effective constitutes acceptance of the revised Terms.
